Preamble
We recommend customers open a trial account before paying for full membership. The trial account is fully functioning and will allow users to explore the product in great detail before making any financial commitment.
Definitions
Member(s) refers to you, the paying member using ArtWeb Service.
The Artists Web or ArtWeb refers to the website service owned and run by:

The Service
ArtWeb provides members with their own website and a specialist cms (content management system) for editing the website. The website is hosted on ArtWeb's own servers and access to edit members websites is only available via the cms.
The members are responsible for creation and editing of their own website using the cms. Changes to the website are restricted to only those changes possible with the cms. Additional feature request for the cms are gladdly received by ArtWeb and some may be included in future updates of the service.
ArtWeb provides email support and documentation on how to use the cms. Members are encouraged to read this documentation before contacting ArtWeb with support queries as most questions should be answered with the documentation. We will also respond to email support requests within a resonable period of time.
Sale of Artwork
The sale of artwork is entirely the responsibility of the member. ArtWeb is merely providing the tools to create a website, including the HTML code required to generate a paypal link. The Member agrees to indemnify ArtWeb against any loss or claim pertaining to their website and the sale of the Members Artwork.
Promotion of Artwoek, Listings on artweb.com and other parts of the ArtWeb Network
For members who have an active subscription to one of the paid membership plans that specifically include listing on ArtWeb, ArtWeb will promote and display the artwork of such members on the website artweb.com, ArtWeb newsletters, on other websites in the ArtWeb network (e.g. blog.artweb.com) and on ArtWeb social media accounts. Members can specify that individual images they upload to the Service not be listed and promoted as aforementioned by unchecking the "list on ArtWeb" option for the specific image. In addition, ArtWeb reserves the right not to display, list or promote as aforementioned any specific or all of a Member's artwork or information.
Requirements for Use of The Service
For the majority of the service all that is required is an internet connection and any modern internet browser. A very small percentage of users may find some non-essential features of the service will not operate with their web browser, due to the differneces in all versions of all internet browsers, we cannot ensure complete compatibility. We reccommend users upgrade to the latest versions of their software to take advantage of the full service, in particular we recommend mozilla firefox.
Availability
ArtWeb service is normally avaiable 24hours a day. Occassionally routine maintenance and upgrades will need to be performed and for brief periods the service will be unavailble. Where possible these periods will be scheduled for times of low usage so as to minimise any disruption. Please note we cannot accept responsibility for any members loss arising due to the service being unavailable for the above reason or any other reason causing disruption.
Fees
The annual fee is payable in advance and each renewing year must be paid before the end of the annual period*. Any Member wishing to withdraw from ArtWeb must give 30 days advance notice of said withdrawal. Fees for other services will be due at the time such services are performed.
Refunds
As a fully functioning trial is available with out any commitment, the fees once paid are not normally refundable. In special circumstances refunds will be made at the discretion of the managment.
Modification of Terms
ArtWeb may at any time modify the terms and conditions of this Agreement by notifying the Member through e-mail or other method of communication. If any modification is unacceptable to the Member, the member may terminate this Agreement. The Member's continued participation in ArtWeb will signify agreement with the modification.
Membership Criteria
ArtWeb may accept individual Members at its sole discretion.
Indemnification
You agree to indemnify, defend and hold ArtWeb, its agents, affiliates, subsidiaries, directors, officers, employees, and applicable third parties (e.g. relevant advertisers, syndication partners, licensors, licensees, consultants and contractors) (collectively "Indemnified Person(s)") harmless from and against any and all third party claims, liability, loss, and expense (including damage awards, settlement amounts, and reasonable legal fees), brought against any Indemnified Person(s), arising out of, related to or which may arise from Your use of the ArtWeb, and/or Your breach of any term of this Agreement.
Domain Names
Members may choose to have an Artists Web domain (i.e. MembersDomainName.artweb.com) or any other domain of their choice (i.e. MembersDomainName.com). We can register domains on a member's behalf - this will attract a surcharge to cover the additional cost of registration.
Please note if we are registering the domain name on your behalf, you cannot change the domain once you have confirmed your choice with us. If you have made a mistake you must pay a surcharge for registering an additional domain.
Domain name transfer
You can transfer ownership of the domain for your site after cancelling your service.
If your service has reached the end of it's term and you do not wish to renew, we will not renew your domain and you can register the domain for yourself once the domain has returned to 'unregistered' status.
If you wish to transfer the domain to your another registrar at any other time, you will need to request the transfer with your new registrar; we will authorise the transfer without charge. Depending on your new registrar, this should normally be a fairly simple process, however we cannot accept responsibility for the success of the transfer once we have authourised the transfer request.
* this is 1 year from the date first joined, except 29th Feb taken as 28th Feb for non leap years.
